Appellants do not have any right in the disputed property - no relief in second can be granted- second appeal dismissed.


Code of Civil Procedure, 1908 Section 100-Second appeal-Suit filed by plaintiff-respondent for cancellation of sale-deed dated April 28, 1988 executed by defendant- appellant Nos. 1 to 3 in favour of defendant-appellant Nos. 4 to 8 and for permanent injunction restraining defendants-appellants from raising any construction or interfering in possession of plaintiff over property in dispute, granted injunction order, later decreed by trial court against same appeal dismissed- Sustainability of-On basis of evidence on record, found plaintiff. respondent-purchaser was throughout in possession of property in dispute while defendants-appellants first set after becoming major initiating proceedings under Section 229-B of U.P.Z.A. & L.R. Act to be dismissed and never initiated any other proceedings for possession of property in dispute-Admittedly observed both sets of appellants lost right in their favour as stipulated- Held, appellants did not had any right in property in question-Appeal sans merit accordingly dismissed.
