Magistrate has jurisdiction to issue warrant to the Collector for defaulted maintenance as arrears of land revenue.









Civil Procedure Code, 1908-Section 100-Criminal Procedure Code, 1973- Sections 125(3) and 421(1)-Second appeal-Suit for declaring proceedings of revenue sale-deed as null and void-Property sold in execution of order of main- tenance passed under section 125 Cr. P.C. by issuing a warrant to Collector-To recover same as arrears of land revenue-Sustainability of order-Magistrate has power to enforce an order of maintenance under section 125, Cr. P.C. by issuing a warrant to collector to recover same as arrears of land revenue-Suit rightly dismissed-Appeal dismissed.
