Consumer Protection Act, 1986 Section 2(1)(g) Housing project - Delay in handing over possession - Whether the Opposite Party is liable for deficiency in service in so much so it failed to offer possession within the stipulated time - Yes - Held that the Opposite Party is deficient in providing its services to the Complaint as the Opposite Party failed to comply with the contractual obligations as per Memorandum of Understanding and Agreement - Opposite Party failed to handover the possession of the said residential unit even after passage of 7 years from the date on which parties entered into agreement - Refund with interest.
