Merely because the complainant and eye-witness did not support the prosecution version- compensation can not be denied.


Motor Vehicles Act, 1988 Section 173 Fatal accident case - Appeal by Insurance Company - Merely because the complainant and eye-witness did not support the prosecution version, would not mean that the claimants are not entitled for compensation - Rs.40,000/- for loss of consortium and Rs.15,000/- for funeral expenses added - Therefore impugned amount of compensation of Rs.9,02,800/- upheld - Appeal dismissed.
