क्या धारा 483 सीआरपीसी के तहत परिवार न्यायालय को धारा 125 सीआरपीसी के शीघ्र निपटान के लिए निर्देश देने की मांग करने वाला आवेदन विचारणीय है ?

इलाहाबाद उच्च न्यायालय ने एक महत्वपूर्ण निर्णय में माना है कि दंड प्रक्रिया संहिता (सीआरपीसी) की धारा 483 के तहत एक आवेदन पारिवारिक न्यायालय को धारा 125 सीआरपीसी के तहत एक आवेदन पर शीघ्रता से निर्णय लेने का निर्देश जारी करने के लिए विचारणीय है। यह निर्णय "शिव पंकज एवं अन्य बनाम उत्तर प्रदेश राज्य के माध्यम से प्रधान सचिव गृह लखनऊ एवं अन्य" [धारा 483 संख्या - 426 वर्ष 2024 के तहत आवेदन] शीर्षक वाले मामले में आया। इस मामले की सुनवाई न्यायमूर्ति सुभाष विद्यार्थी की एकल पीठ द्वारा की गई। 

The applicants, Shiva Pankaj and his

daughter, had filed an application under

Section 125 CrPC before the Family

Court in Lucknow, seeking maintenance

from the husband/father (opposite party

no. 2). However, the Family Court had

not decided their interim maintenance

application expeditiously, despite the

statutory mandate under the third

proviso to Section 125(1) CrPC to

dispose of such applications within 60

days of issuing notice

Aggrieved by the delay, the applicants

filed the present application under

Section 483 CrPC before the High Court,

seeking a direction to the Family Court to

decide their pending interim

maintenance application expeditiously.

On the second issue, the Court noted

that under Section 7(2)(a) of the Family

Courts Act, a Family Court has the

jurisdiction exercisable by a Magistrate

of the First Class under Chapter IX

(relating to maintenance orders) of the

CrPC. Therefore, while deciding an

application under Section 125 CrPC, the

Family Court exercises the jurisdiction of

a Judicial Magistrate.

आवेदन को स्वीकार करते हुए न्यायालय ने पारिवारिक न्यायालय को निर्देश दिया कि वह धारा 125(1) सीआरपीसी के तीसरे प्रावधान के तहत 60 दिन की वैधानिक समयसीमा को ध्यान में रखते हुए लंबित अंतरिम भरण-पोषण आवेदन का शीघ्र निपटारा करे।
