Courts are empowered under Section 7(1)(b) of Family Courts Act, 1984 read with Section 2 of Act of 1939 and Section 2 of Act of 1937 to pass a decree to dissolve a marriage.
Dissolution of Muslim Marriages Act, 1939 Section 2 Muslim Personal Law (Shariat) Application Act, 1937, Section 2 - Family Courts Act, 1984 Section 7(1)(b) Khula Certificate - Courts are empowered under Section 7(1)(b) of Family Courts Act, 1984 read with Section 2 of Act of 1939 and Section 2 of Act of 1937 to pass a decree to dissolve a marriage - But private bodies such as Shariat Council cannot pronounce or certify dissolution of marriage by Khula - Khula certificate issued by Shariat Council, quashed.
